General terms and conditions for clients

Booking conditions
These terms and conditions are an integral part of all offers by, assignments addressed to, and agreements made with Galucci Int. Model & Casting Agency, trading under the name: Modellen en Casting bureau Galucci Chamber of Commerce number: 7025 718 3, referred to in these terms and conditions as 'Galucci'
Granting an assignment, whether the first or a follow-up, to Galucci entails acceptance of these rules. These general terms and conditions prevail over any general terms and conditions applied by clients. Deviations from and exceptions to these terms and conditions are only valid if agreed in writing by all parties.

Guarantee
Galucci undertakes to carry out, with due care, the assignments provided. Galucci guarantees the soundness and quality of the execution of client-approved assignments it is tasked with.

Bookings
A booking is considered to have been issued when the client, user, or their representative uses Galucci to book a specific model. The following applies to final bookings as well as taking an option to book. In the absence of any agreement to the contrary with Galucci, the booking confirmation sent to the client or the invoice with the stated specifications and exclusivities are binding between the parties with regard to determining the content of the agreement. The booking confirmation serves as the basis for the calculation of the rate, the surcharges, and the model prices, without prejudice to a model's right in principle to reject a booking order.

Cancellations
No costs will be charged in the case of bookings for a day, part of the day, or an hour if such a booking is cancelled at least 24 hours before the time for which the booking was made. If cancelled on the booked day, 50% of the agreed fee will be charged. In the case of multi-day bookings, the notice period is equal to the number of days booked; if that period is not observed, the full fee is owed. Saturdays, Sundays, and public holidays recognized in the Netherlands will not be included in the calculation of the aforementioned periods.

Cancellations in the case of weather permit bookings
In the case of 'weather permit’ bookings (bookings that explicitly depend on certain weather conditions), there are no costs for the first cancellation due to weather conditions that are undesirable for the booking, provided that this cancellation is made within a reasonable period of time. In case of a second cancellation: 50% of the agreed fee. In case of further cancellations: 100% of the agreed fee.

Rights of use
The client is not permitted to use the materials in ways other than expressly agreed in advance with Galucci. The client only acquires the right to the agreed use of the materials after the payment of all amounts due in this respect is made.

Liability
Galucci is not liable to either clients or models for any damage or resulting costs of any nature arising during work as a result of the agreed assignment.

Both Galucci's clients and models indemnify Galucci against any liability arising from the agreement that semi-governmental organizations as well as the Dutch Tax and Customs Administration may endeavour to recover from Galucci.

Involved persons, whether Galucci's clients or Galucci's models, therefore commit themselves to take out liability insurance and healthcare insurance during agreed work. Galucci is NOT liable to models, clients, or any third parties for any accidents that result in the permanent disability or death of a model en route to, returning from, or at the location as a result of the agreed work.
